Official Operational Policies & Legal Framework

This document is drafted based on the current applicable laws and decrees of the United Arab Emirates (UAE) and serves as a fundamental policy framework for websites and commercial contracts. The legal owner/legal representative of Muyun Gulf Marketing Service LLC reserves the right of final interpretation. Before official commercial implementation, it is highly recommended to have the text reviewed by a licensed local legal counsel.
1. Delivery & Service Logistics
Since our company primarily provides digital marketing, e-commerce operations management, and offline festival/art event marketing services, our delivery procedures are separated into digital deliverables and physical assets:
- Digital Service & System Delivery: All online operational services (including social media setup, ad account onboarding, market data research reports, and e-commerce funnel development) will be delivered through official enterprise digital channels (such as our corporate email info@muyungulf.com or project management systems mutually agreed upon).
- Service Onboarding Timeline: Within 3 to 5 business days from the receipt of the initial advance payment (Retainer Fee) and all essential client onboarding assets (including but not limited to brand authorization letters, ad account permissions, and product creative assets), our team will complete the initial market data research and officially launch operations.
- Offline Event & Material Delivery: For physical materials and structures related to festivals and art events, delivery is strictly limited to the designated venues agreed upon within the UAE (e.g., event sites in Abu Dhabi, Dubai, etc.). Title and risk of loss for physical materials transfer to the client immediately upon on-site sign-off.
- Force Majeure: Our company shall not be held liable for any delivery delays caused by Force Majeure events, including changes in UAE government policies, regulatory shifts, or major third-party social media platform disruptions (e.g., Meta or TikTok global system outages). However, we are obligated to notify the client within 24 hours and provide an optimized recovery roadmap.
2. Refund & Cancellation Policy
In accordance with the provisions of the UAE Consumer Protection Law concerning customized business services and digital content deliverables, the refund and cancellation policies are defined as follows:
- Monthly Retainer Packages:
- Monthly marketing operations (Lean Starter / Market Growth / Enterprise tiers) are classified as real-time labor and intellectual property deliverables. Once operations for the current month have commenced, the service fee for that specific month is strictly non-refundable.
- Subscription Cancellation: Clients must provide a written notice (via official email) at least 30 days prior to the end of the current billing cycle to terminate services for the subsequent month.
- One-Time Services (Data Audits / Account Sprints):
- These services represent bespoke, highly customized market analyses tailored exclusively to the client’s business matrix. Once our data analysts initiate data extraction and market profiling, these services are not eligible for refunds or exchanges.
- Festival & Art Event Marketing:
- If an event campaign is canceled by the client within 15 days prior to the scheduled event date, the initial deposit (typically 50% of the project total) will be forfeited to compensate for human resource hours already expended, physical materials procured, and non-refundable third-party commitments made by our agency.
- Service Dispute Resolution: If the client believes that the delivered marketing outputs deviate significantly from the contractual scope, they must submit a written objection within 7 business days of delivery. Our company will verify the claim within 3 business days and deploy necessary optimizations at no additional cost to meet the agreed standards.
3. Service Warranties & KPIs
Pursuant to the UAE Civil and Commercial Codes and regional agency standards, our service quality assurances are limited to the following terms:
- Compliance Warranty: Our company warrants that all marketing operations, ad buying practices, and data collection methodologies comply strictly with the regulations of the UAE Media Regulatory Office and the official policies of the respective social media networks.
- Cost-Optimization Commitment: We pledge to utilize our advanced data frameworks and tactical expertise to lower your Customer Acquisition Cost (CPA) to the best of our professional capabilities. However, due to market volatility, shifting consumer behaviors, product competitiveness, and ad auction bidding dynamics, our company provides no absolute legal guarantees regarding exact sales revenue or fixed Return on Ad Spend (ROI). All performance metrics are governed by the transparent data pulled directly from platform dashboards (e.g., Meta Ads Manager).
- Third-Party Platform Disclaimer: Any disruptions, data drops, or ad pauses arising from third-party social media algorithm overhauls, automated account reviews/flags, or website hosting server downtimes that are outside our direct control shall not constitute a breach of our service warranty.
4. Commercial Non-Disclosure Agreement (NDA)
This clause is protected under the intellectual property and commercial laws of the United Arab Emirates, enforcing absolute confidentiality regarding information exchanged during the partnership:
- Scope of Confidential Information: Includes, but is not limited to, client product cost structures, profit margins, supplier networks, unreleased festival/art event concepts, and client consumer databases; as well as Muyun Gulf’s proprietary optimization frameworks, data research templates, and custom ad-buying architectures.
- Non-Disclosure Obligation: Neither party shall disclose, distribute, or transfer any confidential information to any third party (including market competitors and media outlets) without the prior explicit written consent of the disclosing party.
- Employee & Contractor Bounds: Both parties shall ensure that their respective employees, subcontractors, and representatives execute equivalent confidentiality agreements before accessing project data.
- Term of Confidentiality: This obligation takes effect immediately upon the initial exchange of information and remains fully enforceable for a period of 3 years following the termination or expiration of the contract. The non-breaching party reserves the right to seek full legal compensation for direct economic damages and associated attorney fees.
5. Website Data Privacy Policy
This Privacy Policy is compiled strictly in accordance with UAE Federal Decree-Law No. 45/2021 on Personal Data Protection (PDPL) and governs all users accessing our corporate website:

- Your Rights Under the UAE PDPL: As a data subject, you possess the following statutory rights:
- Right to Information & Access: The right to be informed about how your personal data is being processed.
- Right to Rectification: The right to request immediate updates or corrections to inaccurate personal data.
- Right to Erasure (Right to be Forgotten): The right to request the deletion of your records, provided it does not conflict with UAE financial, tax, or corporate auditing mandates.

6. Governing Law & Jurisdiction
Jurisdiction: Any dispute, difference, or controversy arising out of or relating to these terms, website operations, or service agreements shall first be addressed through amicable corporate negotiations. If a resolution cannot be reached, either party retains the right to submit the dispute to the exclusive jurisdiction of the Abu Dhabi Courts.
Applicable Law: The validity, interpretation, performance, and dispute resolution of these terms and operational policies shall be governed exclusively by the laws of the United Arab Emirates.
