- Delivery & Fulfillment Policy
This policy is formulated in accordance with the UAE Electronic Commerce Law (Federal Decree-Law No. 14/2023) regarding logistics services and merchant delivery obligations.
- Digital and Marketing Service Delivery:
- All digital deliverables, including market data research reports, marketing operations analysis, and social media content assets, will be delivered online via the official designated email address (e.g., info@muyungulf.com) or a secure cloud link dedicated to the client.
- After project commencement, delivery times for each stage will strictly adhere to the Service Agreement signed by both parties, and progress will be synchronized in real-time on the data dashboard.
- Event Marketing and Offline Execution:
- For marketing and operations of offline events such as arts festivals and cultural events, the service delivery location is the client-designated or event organizer-approved location within the UAE (including Abu Dhabi, Dubai, and other emirates).
- Our company is responsible for the on-site setup, operation management, and compliant deployment of on-site promotional personnel.
- Returns & Refund Policy: This policy strictly adheres to the UAE Consumer Protection Law (Federal Law No. 15/2020) and Cabinet Administrative Regulation No. 66 of 2023 regarding cancellations of online and offline services.
- Digital Marketing/Data Research Services:
- Given that market data research reports and customized marketing operation plans fall under the category of “technical/intellectual property digital content customized according to consumer requirements,” once data collection, analysis, and delivery to the client are completed, full refunds are generally not accepted.
- If the delivered results are significantly inconsistent with the initially signed contract specifications or advertising descriptions, or contain incomplete data (defective/incomplete), the client has the right to request corrections or a partial refund within 7 days of receiving the results.
- Monthly Service (Retainer) Termination:
- If the client needs to terminate monthly marketing operations (such as Lean Starter, Market Growth, etc. packages), they must send us written notice 30 days in advance as stipulated in the contract. The service fee already incurred for that month will not be refunded, and we will continue to provide services until the end of the billing cycle.
- Event Marketing Changes:
- If an arts festival or holiday event cannot be held due to force majeure (such as the UAE government canceling large gatherings due to weather or security reasons), the relevant execution costs will be calculated based on the actual labor and material costs incurred. Any remaining unexecuted budget will be refunded to the client.
- Quality Assurance and Service Commitment Terms (Warranty & SLA) This clause is formulated in accordance with Article 10 of the Consumer Protection Law (Supplier Warranty Obligations).
- Marketing Service Quality Assurance:
- We guarantee that the market research data and channel analysis we provide are technically accurate and compliant with industry standards, and that all marketing operations and management comply with the advertising policies of mainstream media platforms in the UAE (Meta, TikTok, etc.).
- Corrective Service:
- If any technical defects or configuration errors are found in our advertising system, tracking pixels, or data dashboards, we promise to provide free technical corrections or re-provide the relevant services within 48 hours of receiving written feedback from the client.
- Third-Party Liability Disclaimer:
- We are not legally liable for short-term advertising fluctuations caused by third-party social media platforms (such as Instagram, TikTok algorithm adjustments, or system outages). However, we are obligated to adjust our plans according to the new data model within 7 days to protect the client’s interests.
- Commercial Confidentiality Clause: This clause protects the trade secrets of both parties during market data research and business operations.
- Scope of Confidential Information: This includes, but is not limited to, internal sales data provided by clients, supply chain costs, gross profit margins, unpublished art event plans, our proprietary market research models, and pricing details in the contract between the two parties.
- Confidentiality Obligation: Both parties agree not to disclose the aforementioned confidential information to any third party without the other party’s prior written permission (except in cases where it is legally requested by UAE judicial, tax, or intellectual property regulatory authorities).
- Confidentiality Period: This confidentiality agreement is effective from the date of formal contact and signing by both parties and remains in effect for 3 years after the termination or cancellation of the service contract.
