1. Scope of Application
1.1 These terms and conditions (“Terms”) apply to all market research, data analysis reports, marketing operation management and related services (“Services”) provided by Muyun Gulf Marketing Service LLC (“Company”, “we”, “us”) to its clients (“you”, “Client”).
1.2 By accepting our Services, you are deemed to have read, understood and agreed to be bound by these Terms.
2. Description of Services
2.1 Our Services include, but are not limited to: market data research and collection, data analysis and report preparation, marketing strategy consulting, marketing operations management, and delivery of related digital products.
2.2 The specific content, scope, timeline and fees of the Services shall be as set out in the written service contract or order confirmation signed by both parties.
3. Price and Payment
3.1 Service fees shall be those stated in the contract or quotation.
3.2 Payment methods and deadlines shall be as agreed in the contract. We reserve the right to request advance payment.
3.3 In accordance with the Implementing Regulations, we shall not charge any additional fees for consumer payments made by credit card.
4. Delivery
4.1 Digital products (research reports, data analysis plans, etc.) shall be delivered online via encrypted email or our dedicated client system within the agreed timeline.
4.2 If the contract provides for delivery of printed custom reports or physical materials, we will provide delivery services within the UAE. For a single service contract with a value of 1,000 AED or more, the Client is entitled to free door‑to‑door delivery throughout the UAE, with a standard delivery time of 2‑4 business days.
4.3 Invoices must include our trade name, address, description of services, price, quantity and other information required by law. Invoices shall be issued in Arabic, with other languages optionally added.
5. Cancellation and Termination
5.1 Cancellation of service‑based projects:

The Client may cancel within 24 hours after signing the contract / paying the advance payment (provided that the project team has not yet commenced data collection) and receive a full refund.

If the data research or marketing operation project has already commenced, the cancellation request will be settled by deducting reasonable costs proportionally based on completed man‑hours and milestones achieved. A written breakdown of the cost calculation shall be provided to the Client at the time of cancellation.
5.2 Cancellation of physical materials: The Client may cancel the order free of charge as long as the materials have not yet entered the printing / custom production process.
5.3 This cancellation clause does not prejudice the statutory rights of consumers under the UAE Consumer Protection Law.
6. Correction and Rework (Exchange Policy)
6.1 Correction of data services: If the delivered market research report or operational results fail to meet the technical specifications agreed in the contract or contain obvious data errors, the Client may submit a written request for revision within 7 business days after receipt of the deliverable. We will provide free correction services within 10 business days.
6.2 Exchange of physical items: If the delivered printed report or marketing materials have printing defects, damage, or do not match the sample, the Client may apply for a free replacement within 14 days after receipt of the goods.
6.3 If the parties disagree on the determination of “obvious data errors”, the matter may be handled in accordance with Clause 13 (Dispute Resolution) of these Terms.
7. Warranty and Quality Assurance
7.1 We warrant that all market data provided are sourced from lawful and compliant collection channels in the UAE and are authentic and traceable.
7.2 The service warranty period is 30 days after delivery of the report / project. During the warranty period, we provide free data interpretation support and one basic data Q&A session.
7.3 If the Services are defective, the Client has the right to request free correction, re‑performance of the Services, or a proportional refund of the service fees.
7.4 Force Majeure and Exceptions:

We shall not be liable for any delay in service, data fluctuations, or marketing performance impact caused by force majeure events (including but not limited to: natural disasters, war, terrorist acts, government decrees or sudden regulatory policy changes, epidemics, strikes, and other events beyond our reasonable control).

Upon occurrence of a force majeure event, we shall notify the Client within a reasonable time and use commercially reasonable efforts to mitigate the impact and restore services.

If the force majeure event continues for more than 30 days, either party has the right to terminate the contract by written notice, and the fees for the part of the Services already performed shall be settled proportionally.

This clause shall not be interpreted as exempting us from any statutory obligations under the Consumer Protection Law.
8. Confirmation of Consumer Rights
8.1 Under the UAE Consumer Protection Law, consumers are entitled to the following rights:

To obtain a proper and safe environment when purchasing goods or receiving services;

To obtain correct information about the goods purchased, used or consumed, or the services received;
-
To know their rights and obligations;
-
To choose the most suitable products and services in the market according to their own wishes;
-
To receive fair compensation for damages suffered as a result of purchasing or using defective goods, or receiving substandard services.
8.2 Nothing in these Terms shall reduce or exclude the above statutory rights of consumers under UAE law.
9. Limitation of Liability
9.1 To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, loss of profit, or loss of goodwill arising from the use of the Services.
9.2 Our total cumulative liability under any single service contract shall not exceed the total service fees already collected under that contract.
9.3 This limitation of liability shall not apply to losses caused by our gross negligence or willful misconduct, nor to liability that cannot be limited or excluded under the Consumer Protection Law.
10. Intellectual Property
10.1 All research reports, data analysis results, marketing plans and related intellectual property delivered by us shall belong to the Client after full payment of all service fees; however, we reserve the right to use the methodologies, analytical frameworks, and non‑client‑specific data contained therein.
10.2 Without our prior written consent, the Client shall not use our analytical tools, models, or proprietary methods for purposes other than those agreed in the contract.
11. Confidentiality Obligations
11.1 Both parties shall strictly keep confidential all commercial secrets, financial data, internal marketing plans, and client information learned during the cooperation.
11.2 The confidentiality obligations shall survive for 5 years after termination of these Terms.
11.3 Without the written authorization of the other party, neither party shall disclose confidential information to any third party, except as required by laws and regulations or as agreed by both parties.
12. Data Protection
12.1 We shall process personal data in compliance with Federal Decree Law No. 45 of 2021 on the Protection of Personal Data (PDPL) .
12.2 For detailed arrangements on personal data processing, please refer to our Privacy Policy.
13. Dispute Resolution
13.1 Both parties shall first attempt to resolve any dispute arising out of or in connection with these Terms or the Services through friendly consultations.
13.2 If consultations fail, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in Abu Dhabi.
13.3 Consumers have the right to file complaints with the UAE Ministry of Economy or the competent authority in accordance with the Consumer Protection Law.
14. Governing Law
14.1 The interpretation, validity and performance of these Terms shall be governed by the laws of the United Arab Emirates, including but not limited to the Consumer Protection Law (Federal Law No. 15 of 2020, as amended by Federal Decree Law No. 5 of 2023) and its Implementing Regulations (Cabinet Resolution No. 66 of 2023).
15. Severability
15.1 If any provision of these Terms is held by a competent court to be invalid or unenforceable, that provision shall be modified or deleted to the minimum extent necessary, without affecting the validity of the remaining provisions.
16. Amendments
16.1 We reserve the right to amend these Terms at any time. The amended Terms will be posted on our website, and material amendments will be notified to the Client 30 days in advance.
16.2 Any amendment that prejudices consumer rights shall be void under the Consumer Protection Law.
CANCELLATION & RETURN POLICY
Effective Date: 01 January 2026
1. Overview
1.1 This Cancellation & Return Policy (“Policy”) is formulated in accordance with the Federal Law No. 15 of 2020 on Consumer Protection (as amended by Federal Decree Law No. 5 of 2023) and its Implementing Regulations (Cabinet Resolution No. 66 of 2023) .
1.2 This Policy applies to all market research, data analysis reports, marketing operation management and related services (“Services”) provided by Muyun Gulf Marketing Service LLC (“Company”, “we”).
1.3 Nothing in this Policy shall reduce or exclude the statutory rights of consumers under the UAE Consumer Protection Law.
2. Cancellation Policy (Service‑Based Projects)
2.1 Cooling‑off cancellation:

The Client may cancel within 24 hours after signing the contract / paying the advance payment (provided that the project team has not yet commenced data collection) and receive a full refund.
2.2 Cancellation after service commencement:
-
If the data research or marketing operation project has already commenced, the cancellation request will be settled by deducting reasonable costs proportionally based on completed man‑hours and milestones achieved.

A written breakdown of the cost calculation (including man‑hours already invested, data procurement costs, third‑party service fees, etc.) will be provided to the Client at the time of cancellation.
2.3 Cancellation of physical materials:

The Client may cancel the order free of charge as long as the materials have not yet entered the printing / custom production process.
3. Return and Exchange Policy
3.1 Digital products (research reports, data analysis plans, etc.):

Digital products are not accepted for return without reason once delivered.

If the deliverable contains obvious data errors or fails to meet the technical specifications agreed in the contract, Clause 4 (Correction and Rework) of this Policy shall apply.
3.2 Physical materials (printed reports, marketing materials, etc.):
-
If the delivered printed report or marketing materials have printing defects, damage, or do not match the sample, the Client may apply for a free replacement within 14 days after receipt of the goods.

When applying for exchange, the Client shall provide the order number, a description of the problem, and relevant photographic evidence.
4. Correction and Rework
4.1 If the delivered service results fail to meet the technical specifications agreed in the contract or contain obvious data errors, the Client may submit a written request for revision within 7 business days after receipt of the deliverable.
4.2 We will provide free correction services within 10 business days after receiving the revision request.
4.3 If we are unable to complete the correction within a reasonable period, the Client has the right to choose:

Full refund (if the Services have not been substantially performed); or
-
Proportional refund (if the Services have been partially performed); or
-
Re‑performance of the Services.
5. Refund Process
5.1 Refund requests shall be submitted in writing to Muyungulf@gmail.com, accompanied by:

Contract / order number;

Explanation of the reason for refund;

Supporting documents (if applicable).
5.2 We will review and process the refund request within 14 business days after receiving a complete application.
5.3 Approved refunds will be made through the original payment method, and the processing time depends on the bank or payment service provider’s cycle.
6. Consumer Complaints

7. Force Majeure
7.1 We shall not be liable for failure to perform cancellation or refund obligations caused by force majeure events (including but not limited to natural disasters, war, government decrees, epidemics, and other events beyond our reasonable control), provided that we notify the Client within a reasonable time and use best efforts to mitigate the impact.
